HEATING/COOLING
SAVINGS GUARANTEE

New Windows for America agrees and makes the following Limited Warranty to the Buyer for the particular combination of products as described in the Installation Contract and purchased by the Buyer, as follows:
If during the twelve (12) month period following the date of installation of New Windows for America products (the “Warranty Period”) on all windows of the home of the Buyer and on all doors leading directly to the outside, the Buyer does not achieve savings over the previous twelve months in fuel and/or electric usage for heating and “central” air conditioning in an amount equal to or exceeding forty (40%) percent for windows installed with SolarBan 60 Double Paned/Argon Filled Low E Glass or fifty (50%) percent for windows installed with SolarBan Supreme Triple Paned/Krypton Filled Low E glass, under similar conditions, and subject to the general terms and conditions set out herein, New Windows for America shall reimburse the Buyer in an amount equaling the difference between the actual savings and the guaranteed percent (40% or 50%) of such costs for the previous year, provided, however, that in no event shall New Windows for America be liable under this warranty in an amount in excess of Three Hundred Dollars ($300.00)
The following general terms and conditions are applicable to this Warranty:

1. All windows and patio doors must have either SolarBan 60 or Solarban Supreme Glass
2. Claims must be filed in writing, accompanied by supporting documentation within thirty (30) days of the expiration of the Warranty Period. Acceptable supporting documentation includes utility company receipts attributable to energy consumption for heating and “central” air conditioning during the Warranty Period.
3. Claims must include only costs incurred for energy consumption attributed to heating and “central” air conditioning. Other energy costs including, for example and not by way of limitation, costs for cooking, laundry, lighting, etc. must be deducted. New Windows for America will use a formula of twelve (12) times the May utility billing to determine a fair deductible amount of the utility costs incurred other than for heating and “central” air conditioning
4. If utility rates are increased, New Windows for America will use the rates applicable to the price period to determine its liability under this Warranty.
5. In the event Buyer increases the square footage living area of the home during the warranty period, this Warranty shall be void and of no further force or effect.
6. This warranty is applicable only to the installation of windows and doors on a single family residence and shall not apply to the installation of products on multi-family homes or apartment houses, or in any commercial premises.
